By accessing or using Evidence Pack ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including organization owners, supervisors, and guards.
Evidence Pack is a security operations platform that provides GPS-verified check-ins, incident reporting, AI-powered compliance checking, scheduling, and documentation tools for security companies and their clients. The Service is provided on a subscription basis.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and PIN. You must notify us immediately at info@getevidencepack.com if you suspect unauthorized access to your account.
One account may represent one security organization. You are responsible for all activity that occurs under your account.
You agree not to use the Service to:
You retain ownership of all incident reports, photos, and operational data you submit to the Service. By submitting content, you grant Evidence Pack a limited license to store, process, and display that content solely to provide the Service to you.
You are solely responsible for the accuracy and legality of the data you submit, including compliance with any applicable privacy laws when collecting and storing information about individuals in incident reports.
Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. Prices are listed in USD and are subject to change with 30 days notice.
Free trials last 14 days. No credit card is required for the trial. After the trial, you must subscribe to continue using paid features. We do not offer refunds for partial billing periods except where required by law.
Operational data is retained according to your plan: 6 months (Starter), 1 year (Professional), or 3 years (Business). Upon account termination, your data will be retained for 30 days during which you may request an export, after which it will be permanently deleted.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. EVIDENCE PACK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GPS DATA WILL BE ACCURATE IN ALL CONDITIONS. THE SERVICE IS A DOCUMENTATION TOOL AND DOES NOT GUARANTEE ANY PARTICULAR LEGAL OUTCOME.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVIDENCE PACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Evidence Pack and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.
Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease. We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
We may update these Terms of Service from time to time. We will provide at least 30 days notice of material changes via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
These Terms shall be governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Kent County, Michigan.
